Fiduciary Officer

Our client, a Fiduciary Company is seeking a 5 plus years Fiduciary Officer to grow the business that will have meaningful impact on clients’ lives. This is a hands-on leadership role, where you’ll take the business to scale and hire your own employees along the way to partner with you on this important work. The Fiduciary Officer will have a deep technical fiduciary knowledge in the areas of trusts, tax, fiduciary investing, regulation, compliance as well as having a focus on special needs and/or estate planning trusts with an interest in business development. The Fiduciary Officer will manage all types of fiduciary accounts, including “traditional trusts,” Special Needs Trusts (SNTs), conservatorships, in accordance with the terms of governing documents, governmental agencies/public benefits, and applicable law, and consistent with the needs of the grantors, beneficiaries, and remainder persons. Responsibilities will include; establishing and updating all administration documentation; evaluation of accounts for completeness and accuracy; monitoring and reviewing account transactions; overseeing set-up of new accounts, including preparing client correspondence and ensuring receipt of proper documentation and implementation of consistent and complete policy and procedures; reviewing third-party investment strategies and performance to ensure they are in line with the account’s defined objectives; reviewing of ongoing and initial real estate and other asset purchases to ensure that proper steps are taken to purchase and maintain any real estate or other asset transactions; reviewing periodic fee calculations and assessments, and ensuring that appropriate tax documentation is prepared and provided. The Fiduciary officer should have 7 plus years of drafting experience as an Elder Law Attorney or Professional Fiduciary with experience administering SNTs in Colorado and familiarity with all aspects of means-tested benefits, Social Security Administration, and CO HCPF regulations.
